Town of Patagonia Apologizes to OSN, will “Not Tolerate any Further Restrictions on Freedom of Speech.” SEE THE VIDEO

The town of Patagonia has issued an apology for violating the First Amendment rights of the OSN and has pledged to not tolerate any further restrictions on speech.

In a statement read by Patagonia Mayor Andrea Wood last night at the Town Council meeting, the town stated;

“The governing body of the town of Patagonia would like to apologize for the First Amendment rights violation inflicted upon Hilde Lysiak, a young reporter who is in our community. “

“We are sorry Hilde, we encourage and respect your continued aspirations as a successful reporter. We believe and fully support the constitutional right to freedom of speech in the public sector. We will not tolerate bias of any kind including infringement of freedom of speech.”

“We the governing body acknowledge our negligence and sincerely apologize to all who felt their constitutional rights were violated.”

The OSN was working on a story in Patagonia, Arizona when a law enforcement officer threatened the reporter (FULL DISCLOSURE: THE REPORTER WAS THE AUTHOR OF THIS STORY) with arrest unless she stopped reporting the news.

The OSN was biking down Roadrunner Lane investigating the tip at about 1:30 pm on February 18th when the reporter was stopped by a Patagonia Marshal and asked for identification.

The Orange Street News identified herself as a member of the media, including name and phone number.

“I don’t want to hear about any of that freedom of the press stuff,” said the marshal.

The marshal continued “I’m going to have you arrested and thrown in juvey. “

Asked what he could arrested for, the officer first said it was for “disobeying his command,” then said it was for riding on the wrong side of the road. Finally, the officer said a Mountain Lion was spotted in the area despite their being other people in the area who were not kicked off the road.

“I’m worried about your safety, the area you were in we were dealing with a mountain lion,” said the marshal.

“If you paste my face on the internet it’s against the law so I’m not giving you permission to use my picture or my face on the internet, do you understand all that?”

The court says the First Amendment gives citizens the right to record police officers in public while they are performing their duties. But that doesn’t mean you’re allowed to record if you’re doing so secretly interfering with the officer, or otherwise breaking the law.

    Big congratulations on your success Miss Lisiak, and kudos to the Patagoina Town Council for recognizing their officer had overstepped his duty to step on your rights.

    There are a number of us who hold east Santa Cruz County dear – and willingly take to task public officials who, with some regularity, make up their own rules – ignoring state mandated ethical standards and even the US Constitution. The Patagonia City Council has done the right thing in extending its sincere apologies for your recent very distasteful experience. Seems that lesson was learned and similar episodes will not be occurring. Good for Patagonia (and GOOD for you, Hilde, for bringing this constitutional issue to the attention of not only your readers but readers across the US.

    WONDERFUL. Ms. Lysiak’s victory reaffirms the right of journalists and everyone else to live in a society that values freedom of speech and freedom of the press. Given the endless attacks on the media by the highest elected official in our country, it is essential that we support courageous journalists of every age, including age 12. Reading this story makes me proud to be a subscriber of Orange Street News.

    News of this reached around the world and I’m very happy to see that town of Patagonia did the right thing here. A free press and the guts to stand up for it, is a vital component to freedom in all countries of the world. I was very impressed by the reporting, please keep up the great work.
