The OSN was working on a story in Patagonia, Arizona when a law enforcement officer threatened the reporter with arrest unless she stopped reporting the news.
The OSN was biking down Roadrunner Lane investigating the tip at about 1:30 pm on February 18th when the reporter was stopped by Patagonia Marshal Joseph Patterson and asked for identification.
The Orange Street News identified herself as a member of the media, including name and phone number.
“I don’t want to hear about any of that freedom of the press stuff,” said Patterson.
The Marshal continued “I’m going to have you arrested and thrown in juvey. “
The Marshal didn’t have his lights on and passed several people who were on the streets without stopping them or questioning them.
“I can have you arrested, do you understand?” the Marshal answered.
Asked what he could arrested for, the officer first said it was for “disobeying his command,” then said it was for riding on the wrong side of the road. Finally, the officer said a Mountain Lion was spotted in the area despite their being other people in the area who were not kicked off the road.
“I’m worried about your safety, the area you were in we were dealing with a mountain lion,” said Patterson.”
“I gave you a lawful order and if you disobey a law enforcement officer….Lying to me and saying you were going to your friends house wasn’t acceptable.”
“If you paste my face on the internet it’s against the law so I’m not giving you permission to use my picture or my face on the internet, do you understand all that?”
The OSN answered, “I understand all that.”
The court says the First Amendment gives citizens the right to record police officers in public while they are performing their duties. But that doesn’t mean you’re allowed to record if you’re doing so secretly interfering with the officer, or otherwise breaking the law.
The Officer told the reporter he was calling her parents.
“You aren’t an adult so don’t act like,” Marshal Patterson said before driving off.
Well your reporter obviously know more about the law than that bully cop. Keep her on your payroll, she will go a long way. 🙂

It is apparent that patrolman Joseph Patterson is harassing the twelve-year-old reporter.
Maybe he has a thing for 12 year old girls
The community better keep an.eye on him.

Nothing in that article says police are more likely to assault you. Also, Washinton Post is false news. They do not try to report unbiased news. Therefore, they cannot be trusted anyway.

In case you didn’t know, Marshal Patterson was hired in 2011 amid controversy with the previous Marshal. But he had fishy background of his own.
“Patterson also said that he had been “wrongfully terminated” from a law enforcement position on the Tohono O’odham Reservation after being accused of stabbing tires of vehicles used by illegal immigrants, which he said was common practice. He was not given his job back.”
Huh.

If one of the adults assaulted her and he had driven by…or the mountain lion attacked her and he had driven by he would be brought up on charges for dereliction. Now someone accuses him here of being a pervert for doing his job!
We have the “rule of law” and the officer did nothing but warn the girl away from following him which can be a violation of the law. What do you people want? Maybe she should die so you can beat him up for that?

The officer was trying to intimidate the reporter “under color of the law”. Which is illegal.

Evidently there was. Elsewhere on the Orange Street News is a picture of the mountain lion obtained by the publisher through diligent investigative journalism. Way to find and deliver the truth, Hilde!

Well … Yeah…there was a mountain lion. In fact, Ms. Lysiak reported on said mountain lion in another post. Your point being…what, exactly? And, if that were really his primary concern, he didn’t lead with that…why? “Don’t want to hear about that freedom of the press stuff” and “going to arrest you and put you in juvie” do not sound like the kinds of things someone would say if they were primarily concerned about safety. Now if he had instead started with, “There is a dangerous mountain lion in the area, and I’m worried for your safety. I would ask you to please vacate the area, along with all of these other good people hereabouts”, I might buy that. He did not. I do not.

Well, funforone58, he lied to her about what was illegal and threatened her with imprisonment for doing her job. The rule of law to which you refer does not allow police to behave in this manner, which is exactly why his employer took disciplinary action against him. No one said he was a pervert, though it’s rather curious that he was so interested in a twelve year old doing absolutely nothing wrong when he didn’t take a similar interest in other people who were also in the vicinity.

Some of these stories are not the “the local store was recently burglarized” stuff. Drug dealers and politics is pretty heavy stuff!! I love that you stood your ground with the Marshal Patterson! (He was just trying to intimidate you – Glad you stood your ground!)
I’m betting in 12 more years we’ll be hearing alot more of you name. Likely working at the Washington Post as the female investigative Bob Woodward!

As a 78 yr. old grandfather who has dealt with LEOs, good and bad, all my life. I am sure that the officer was concerned for your safety, even if wrong about the law. A former Metro Nashville police taught me pool many, many years ago. Much later a MNPD sergeant trained me for a carry permit even though another MNPD officer told a merchant it was illegal for me to carry. 78 with artificial foot, I have reason.
You have good and sufficient reason and strength of will to safely carry out a duty as important as that of any first responder. To quote an old TV show before your time, “Be safe out there.”
