The OSN was working on a story in Patagonia, Arizona when a law enforcement officer threatened the reporter with arrest unless she stopped reporting the news.
The OSN was biking down Roadrunner Lane investigating the tip at about 1:30 pm on February 18th when the reporter was stopped by Patagonia Marshal Joseph Patterson and asked for identification.
The Orange Street News identified herself as a member of the media, including name and phone number.
“I don’t want to hear about any of that freedom of the press stuff,” said Patterson.
The Marshal continued “I’m going to have you arrested and thrown in juvey. “
The Marshal didn’t have his lights on and passed several people who were on the streets without stopping them or questioning them.
“I can have you arrested, do you understand?” the Marshal answered.
Asked what he could arrested for, the officer first said it was for “disobeying his command,” then said it was for riding on the wrong side of the road. Finally, the officer said a Mountain Lion was spotted in the area despite their being other people in the area who were not kicked off the road.
“I’m worried about your safety, the area you were in we were dealing with a mountain lion,” said Patterson.”
“I gave you a lawful order and if you disobey a law enforcement officer….Lying to me and saying you were going to your friends house wasn’t acceptable.”
“If you paste my face on the internet it’s against the law so I’m not giving you permission to use my picture or my face on the internet, do you understand all that?”
The OSN answered, “I understand all that.”
The court says the First Amendment gives citizens the right to record police officers in public while they are performing their duties. But that doesn’t mean you’re allowed to record if you’re doing so secretly interfering with the officer, or otherwise breaking the law.
The Officer told the reporter he was calling her parents.
“You aren’t an adult so don’t act like,” Marshal Patterson said before driving off.
“Finally, the officer said a Mountain Lion was spotted in the area despite their being other people in the area who were not kicked off the road.”

As an ESL teacher for 13 years now, I can tell you with conviction that the English language is likely one of the most difficult languages to learn, even for native speakers when put into writing. Thank you for labeling this as a typo and not a lack of fluency: I see this sort of thing on AP and Reuters reports quite frequently as well.

“I gave you a lawful order” He did NOT give a lawful order.
Threatening a minor child with kidnapping is a crime.
And illegal detainment/arrest is considered a felony criminal offense.
It is also legal to resist such an illegal event.

Watch this space, World! Hilde Kate Lysiak WON’T BE 9 or 12 FOREVER!! It is my (elderly and) considered opinion that will not be the last time you hear about Ms. Lysiak, because she certainly has everything she needs to pilot & Captain her own Life Ship; she can & will Adventure every Sea that piques her interest & stimulates her intelligence! It’s refreshing to discover a “Curious Georgina” with an “Inquiring Mind”…out on a bicycle, “chasing down the news”…when most kids seem to be tied to a wi-fi signal playing Fortnite or Minecraft! (God forbid you ask your Grandkids to make their own beds, or set the table & they are tied to SnapChat even while in the pool!) Hilde Lysiak has got to be a source of wonderful joy to her siblings, parents & grandparents! Never stop being YOU, Hilde!!

This officer missed a great opportunity to make friends with a wonderful young lady. He should have spent a little time thanking her for this unique initiative she’s undertaking. Instead, he turned it into a confrontation. Sad. Fortunately, she was smart enough to record it so it wasn’t just he said/she said in which the officer of the law would have been the more most people believed. I was impressed that she kept her cool and was not cowed.

Also, since “Free Speech” seems to be a Key Issue with you Hilde, I would like to ask your help in helping me EXPOSE the U.S. Department of Veterans Affairs (VA) for trying to use EXTORTION on me by saying if I don’t SIGN a “Behavior Contract” agreeing NOT to Contact Members of the News Media, or Members of Congress, or their Staff Members, then I will ONLY receive ‘Emergency Care’ from the VA & they will not give me any Cancer Treatment !!!

As a retired teacher it gives me great comfort and inspiration and reassures my faith in humanity. She is mature beyond her years and I’m confidant that she’ll be a ‘mover and shaker’ in whatever undertaking is presented to her. You go girl!

It is not safe for a child to follow law enforcement around while they’re doing they’re job. You people are teaching this girl to disobey authority. It would be different if she were an adult trying to report the news, but when a LEO tells a child it’s not safe, it’s probably because it’s not safe. Here’s an idea- see if the local PD will allow you to do a ride along with parents permission. You’ll be able to report the news and be under the protection of the law enforcement.

You might want to reread the story, as Ms. Lysiak was *not* “follow[ing] law enforcement around while they’re doing they’re [sic] job.” Instead, she was in the area reporting on a story. She produced identification when the LEO stopped her and requested it. He threatened her with arrest and imprisonment. He did nothing of the sort to others who were also in the area. And he was the subject of disciplinary action by the department where he works, which suggests that his superior officer was not as quick to excuse the officer’s inappropriate behavior as you seem to be. Your information is based on the article written by the same child who was in the altercation. This is called “fake news”. If you would talk to any adult involved in the police investigation going on at the time, you would find out that the girl was indeed puttting herself in harms way by following law enforcement. The officer was correct to instruct her to quit following. He was incorrect to inform her that she couldn’t put his face on the internet, which is probably why there was disciplinary action. However, you and many others make assumptions by reading a child’s article and watching a short video clip. You then call your assumptions fact. It is fake news.

Crying “fake news” is not proof that what was reported is not what happened, blogdog99. While there are many links available from some pretty big players in the profession of reporting news which support Ms. Lysiak’s version of events, I can’t find anything to support your assumptions about either Ms. Lysiak or her account of what occurred. It’s not “fake news” because you don’t like the story or because you disapprove of the person telling it.

Let me fix your statement:
It’s not safe for anyone to follow law enforcement while they’re legally assaulting people. You people are teaching this girl to risk her life resisting authoritarian tyrants. It would be different if she had the legal right to defend herself, but when an armed brute tells someone it’s not safe, it’s probably because he’s an armed brute with the right to legally assault someone. Here’s an idea – don’t let the police see you or your parents. You are a target for law enforcement and government surveillance for reporting the news.

And no, I really don’t care about the “facts” you so speak of, because we humans are dumb animals who know nothing and understand nothing. All we have is our perception, our opinion, of a tiny slice of reality. And you see a much tinier slice than I do. Yes, the police legally assault people. Defending yourself against a police officer is a crime often punishable by death. I also consider arrest to be legalized kidnapping, and I consider our laws to be worthless words. Which is precisely why the police should have no legal authority over anyone else.
The division between “fact” and “feeling” is a false dichotomy created by narrow-minded individuals such as yourself. Go ahead, boast about your age, your college education, your military experience, some other “achievement” you feel gives you authority over me. It means nothing. In the grand scheme of things, you and I are both just naked apes on a speck of dust floating through space. Lawmakers and law enforcement officers are wasting their short time here on Earth. Needless to say, tacking “shame!” at the end of your short-sighted comment only makes you seem desperate and self-righteous. You don’t know the meaning of shame.

Marshal Patterson is being laughed at all over the world. “Bested” by a 12yr. old, who seems to know more about the law than he does! And a Chief Marshal threatening a child – not good.
And the law cited on the city’s webpage (ARS13-2401) does not prevent her showing a video of his face and car, as there is zero threat to his safety – just a threat to his pretensions and arrogance. Patterson could do with a bit of “savoir faire”. Hilde Kate can explain what that is to him, she has it abundance!

This isn’t, BY FAR, the first incident revolving around E. Santa Cruz County (Patagonia, etc.) public officials (appointed or elected) making up their own rules and overreaching their authority. Keep your eyes posted on the Nogales International over the coming 4 weeks or so – should be followup story re: AZ State commission issuing public reprimand against former Patagonia Marshal (in capacity of forced retirement judge….12-31-18).

Nap, Zijuziju bought a subscription for Joseph Patterson, the LEO who hassled Ms. Lysiak. The published address you’re so worried about is the location of Marshal Patterson’s post office box. I doubt anyone is going to hang out at the Patagonia post office waiting to cause him harm when he stops by to pick up his mail.

It’s very impressive to see a 12 year old not only standing her ground when right is right but also having such an interest in reporting. There are still a few good reporters around but barely any great ones anymore. Keep it honest, don’t lose your integrity no matter what you are offered in return. Let people know when you are reporting facts and when you are reporting your opinions of the facts and you could someday become one of the great ones.

The freedom of using your rights, actually liberties, is never free.
In the end game the stake in the game is your life. Most often it is enough to threaten people by property confiscation to make them submit to power. Sometimes the threat of physical violence is enough. Seldom the death.
